WOO’S SIX SENSES IBIZA PRIZE DRAW (“Prize Draw”)

Any personal data provided in accordance with this Prize Draw will be processed in accordance with https://woo.itv.com/privacy-policy.

TERMS AND CONDITIONS OF ENTRY:

Who can enter:

Prize Draw is open to entrants who are UK residents during the Prize Draw period and prize fulfilment period, aged 18 years or over, and not employees of the Promoter and ITV, their immediate families, and anyone else professionally connected with the Prize Draw, who: (i) have registered or have already registered to receive the Promoter’s newsletter on woo.itv.com (“Website”); and (ii) followed Woo on Instagram; between 2 May 2023 and 30 June 2023.

By taking part in the Prize Draw entrants accept and agree to the following terms and conditions. Any entrant who does not agree with any of these terms and conditions should not take part in the Prize Draw.

The Promoter reserves the right in its sole discretion to ask for evidence to verify the age, identity and/or eligibility of an entrant at any time, and to use any channels and methods available to carry out checks of any details provided. The Promoter may withhold delivery of a prize until it has received such evidence from the winner and failure to provide such evidence in a timely manner may result in forfeiture of the prize.

Entries must not be sent in through agents, third parties or on behalf of another person. Such entries are void. Bulk entries are void and cannot be accepted.

Opening/closing date & time:

Prize Draw opens for entries online via Website on 2 May 2023

Prize Draw closes for entries online at 10.00am on Tuesday 30 May 2023.

Winner selection & contact:

The draw will take place within one (1) week of the closing date and time for all entries.

Subject to eligibility and compliance with all applicable terms and conditions, the first entry drawn at random from all eligible entries will win the prize.

All entrants must be contactable after 10.00am on 30 May 2023 and on 31 May 2023.

The winners will be contacted as soon as practicable on or after the draw. Reasonable efforts will be made to contact the winners to the email addresses provided when entering the Prize Draw. The Promoter will attempt to contact the winner three times in a three-hour daytime period over a two-day day period, and will indicate in each communication the deadline by which the winner has to respond to the Promoter.

Please note that if the winner does not reply to the Promoter by deadline set out in the Promoter’s emails to the winner, or if the winner fails to meet any of the eligibility requirements or is otherwise unable to comply with these terms and conditions, this may result in forfeiture of the prize and the Promoter reserves the right to disqualify that entrant (without further liability to that entrant) and offer the prize to the next eligible entrant and thereafter until a winner is found.

It is the entrant’s responsibility to ensure that they control access to any email address that they use to enter. The Promoter and/or its group companies shall not be responsible for any loss the entrant suffers as a result of the Promoter dealing in good faith with anyone other than the entrant who has access to any such number (or any device using any such number).

How to enter & cost of entry:

Entrants may enter online by going to the Website and following the instructions. The entry will only be valid if entrants: (i) have registered or have already registered to receive the Promoter’s newsletter on the Website; and (ii) followed @feelgoodwoo on Instagram between 2 May 2023 and 30 May 2023 and remain so on 30 June 2023. There is no charge for entry but internet service provider’s fees may apply when accessing the internet.

If entrants choose to enter the Prize Draw, personal information they have provided to the Promoter as part of the Prize Draw entries and confirmation that they have fulfilled all entry requirements, will be used by the Promoter and their supplier SweepWidget to administer the Prize Draw and fulfil the prize.

Prize:

There is one (1) prize consisting of aholiday for the winner and an adult companion (18 years old or older) Ibiza, Spain (“Holiday”). The Holiday includes:

accommodation for five (5) nights to Six Senses Ibiza (the “Hotel”), on a bed and breakfast basis, based on two (2) people sharing a room;

one (1) experience for two (2) from the following options (subject to availability):

return transfers between Ibiza Airport and the Hotel.

Please note that the Hotel’s restaurants are subject to availability and some restaurants close during certain period of the year.

The winner will need a current and valid credit/debit card with sufficient available funds in order to check in at the Resort for security deposit purposes.

The Holiday must be booked and taken up by 31 December 2023 (subject to availability) and cannot be taken during any of the following blackout periods: (i) 2 November to 5 November 2023, or (ii) 20 December to 31 December 2023. Please note that the summer months June, July and August are high season therefore the prize provider cannot guarantee availability.

It is the responsibility of the winner to:

ensure that they and their companion hold a current and valid passport and any other travel documentation required to travel to and entry to Spain (including but not limited to Covid-19 documentation). Particular attention should be given to travel advice as available at https://www.gov.uk/foreign-travel-advice/spain;

ensure that the travelling party is adequately insured including without limitation covering overseas medical costs;

inform the prize provider of any wheelchair or similar access requirements for the winner and/or their companion when taking up the prize;

adhere to any applicable health and safety guidelines; and

comply with all instructions and requirements as may be specified by the Promoter or any authorised third party to receive and/or take up the prize including but not limited to providing responses within specified time frames, adhering to the itinerary, completing any required forms and delivering any required documentation. The Promoter will not be liable to the winner or any other persons where they fail to comply with such instructions and such failure may result in forfeiture of the prize.

The prize also includes return Economy Class flights for the winner and their companion from a major UK airport closest to the winner’s home address to Ibiza airport, up to £400 (four hundred pounds) ("Flights"). The winner must communicate their preferred travel dates to the Promoter and the Promoter will book the Flights (subject to availability). Please note that the winner will not be able to choose the airline and the times of the Flights. Please note that if the Flights on the winner’s preferred travel dates are worth more than £400, the winner must pay any costs above £400. If the Flights are worth less than £400, the winner and their companion will not be awarded credit and no cash exchange will be offered.

The prizes exclude all other costs and arrangements (other than as specified above), including but not limited to transportation from and to the UK airport, car hire, travel insurance personal expenses, treatments, food and drinks and attractions (other than specified above).

The winners must comply with any directions given to them by the Promoter, the prize provider of the Holiday and/or their agents (including but not limited to providing responses within specified time frames, adhering to the itinerary, completing any required forms and delivering any required documentation) and with all relevant laws, rules and regulations, restrictions, itinerary. The Promoter will not be liable to the winner or any other persons where they fail to comply with instructions and failure to comply with instructions, itineraries, rules, restrictions, requirements, laws and guidelines may result in an invalid entry and/or forfeiture of the prize.

No cash equivalent or alternative prize will be given at the request of a winner and the prize is non-transferable and non-exchangeable. The winner and their companion acknowledge that in the event that the Hotel or the Flights are cancelled for any reason, or that the winner and their companion miss the Flights, the Promoter does not accept responsibility in these circumstances and no alternative prize will be provided.

Please note that the prize is subject to availability and to winner confirmation, i.e. the Promoter has managed to contact the winners and confirm eligibility. The prize is also subject to the terms and conditions of the prize provider of the Holiday, of the airline (as confirmed by the Promoter), their agents, and where applicable to the terms of the companies through which the travel to and from the Hotel is booked. The winners and their companions may be required to provide their signature as proof of their agreement to relevant waivers, releases and/or consents when taking up the prize. Failure to sign any relevant documentation may result in forfeiture of the prize.

The Promoter reserves the right to change the prize or any part of the prize to an alternative of equal or greater value for any reason in its sole discretion including without limitation due to circumstances beyond its control or if any part of the prize becomes unavailable. If for any reason the winner chooses not to take up the prize or any part of the prize, the Promoter reserves the right to ask the winner to confirm this in writing and, whether or not such confirmation is received, the Promoter will be able to retain or dispose of the prize (or part of the prize) at its own discretion.

The Promoter may refuse to provide a prize, or seek its recovery, in the event of non-entitlement under these terms and conditions or an entrant's breach of these terms and conditions, fraud or dishonesty, including but not limited to the use of technology which enables an entrant to evade applicable charges when entering the promotion.

General

In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the prize draw service, networks or systems, the decision of the Promoter shall be final.

The Promoter and/or its group companies cannot promise that the services relating to the Prize Draw will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of any problem with any network or line, system, server, software, or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond the control of the Promoter. The Promoter does not accept responsibility where all or any part of the service relating to the Prize Draw is discontinued, modified or changed in any way.

The Promoter or its group companies do not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by any entrant howsoever arising from participating in the Prize Draw or from accepting any prize whether due to any error, omission by the Promoter, its group companies or its or their employees, agents or others or by any other cause.

The Promoter and/or its group companies are not responsible for any damage or loss caused to an entrant (i) which is not reasonably foreseeable to such entrant and to the Promoter and/or its group companies when such entrant entered the Prize Draw; and (ii) is reasonably foreseeable to an entrant and to the Promoter and/or its group companies on entry but is only indirectly related to such entrant entering the Prize Draw.

The Promoter and its group companies will not be liable to reimburse the cost or expenses incurred in making the Prize Draw entry.

The Promoter and its group companies do not accept responsibility in the event that: (i) any entry is lost, delayed or not properly received, registered or recorded; or (ii) for any incorrectly addressed or undelivered entries to the Prize Draw; or (iii) for any disruption, delay or misdirection of such entries.

The Promoter and its group companies reserve the right to amend any element of the Prize Draw for reasons beyond their reasonable control, including but not limited to the unavailability of Prize Draw entry platform before the closing date, or for strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The Promoter and/or its group companies are not responsible for any loss or damage caused to any entrant as a result of any of these occurrences.

Entrants agree to reimburse the Promoter and/or its group companies in respect of any damages suffered by the Promoter and/or its group companies or any losses by the Promoter and/or its group companies resulting from any claim made by a third party in each case in respect of any matter arising from the entrant’s use of the services relating to the Prize Draw in breach of these terms and conditions or from the entrant’s violation of any applicable law or regulation.
